Resolving Professional Differences

It is imperative that agencies work together to safeguard children. However, there may be occasions where an agency representative has concerns about the outcome of a Child Protection Conference and feel that threshold has or has not been met for a child or children to be on a Protection Plan.

These must be raised within 72 hours of the conference meeting.

Multi-agency guidance for responding and reviewing child deaths

Once the initial results of the post mortem (or provisional results) are known an interim/review discussion or meeting should take place between the lead health professional (paediatrician) , child death specialist nurse, police investigator and coroner’s officer to consider this, the outcome of the joint visit ( if undertaken) and the results of any other investigations.

The purpose of this discussion is to:

  • review any emerging information
  • consider what is known about the cause of death and any possible contributory factors
  • determine whether any further investigations or enquiries are needed, including the need for a forensic post-mortem
  • confirm what information can be provided to the family, how this will be shared, and by whom
  • Consider whether a referral to the Partnership’s Child Safeguarding Practice Review Group is required

Criminal and sexual exploitation including serious organised crime and gangs

Child criminal exploitation (CCE) or child sexual exploitation (CSE) often occurs without the child/young person’s immediate recognition, with the child/young person believing that they are in control of the situation. In all cases, those exploiting the child/young person have power over them by virtue of their age, gender, intellect, physical strength and/or economic or other resources. Violence, coercion and intimidation are common, involvement in exploitation relationships being characterised in the main by the child or young person’s limited availability of choice resulting from their social/economic/emotional vulnerability.

Supporting online safety

Safeguarding is everyone’s responsibility and the Sussex Safeguarding Children Partnerships take seriously the statutory role they have to ensure that member agencies co-operate to safeguard and promote the welfare of children and young people in Sussex and to ensure that they are effective in doing so.

It is often unclear in these cases whether the carer is actively fabricating their child’s illness, whether they are simply an anxious parent with a distorted view of their child’s state of health, whether the carer holds inappropriate beliefs or expectations about health and illness, or if the parent and child are interacting in a way that involves the child assuming the ‘sick role’ or the role of a disabled child. Sometimes there are familial or cultural styles of ‘illness behaviour’ that affect how children are presented to doctors. Most of these cases, at least in the initial stages, do not need a safeguarding approach and are probably not ‘true’ FII cases. It should be considered at this stage whether the child is experiencing the forms of emotional abuse or neglect, including medical and/or educational neglect.

Contextual Safeguarding is an approach to understanding, and responding to, young people’s experiences of significant harm beyond their families. It recognises that the different relationships that young people form in their neighbourhoods, schools and online can feature violence and abuse. Parents and carers have little influence over these contexts, and young people’s experiences of extra-familial abuse can undermine parent-child relationships.

Therefore children’s social care practitioners need to engage with and recognise individuals, spaces and sectors who do have influence over the young person, within extra-familial contexts, and recognise that assessment of, and intervention with, these spaces are a critical part of safeguarding practices.

Contextual Safeguarding, therefore, expands the objectives of child protection systems in recognition that young people are vulnerable to abuse in a range of social contexts.

It is important to note that perpetrators of criminal exploitation may themselves be children who are criminally exploited and that the victims of crimial expolitation may also be at risk of becoming perpetrators.

Information Sharing

Working Together 2015 states that:

“… all organisations should have arrangements in place which set out clearly the processes and the principles for sharing information between each other, with other professionals and with the LSCB; and no professional should assume that someone else will pass on information which they think may be critical to keeping a child safe. If a professional has concerns about a child’s welfare and believes they are suffering, or likely to suffer, harm, then they should share the information with local authority children’s social care.

Information Sharing: Advice for practitioners providing safeguarding services to children, young people, parents and carers (2015) supports frontline practitioners working in child or adult service who have to make decisions about sharing personal information on a case- by-case basis. The guidance can be used to supplement local guidance and encourage good practice in information sharing.” (Working Together 2015)

Information Sharing

Removed-

Working Together to Safeguard Children 2015 states that:

“Effective sharing of information between professionals and local agencies is essential for effective identification, assessment and service provision.

Early sharing of information is the key to providing effective early help where there are emerging problems. At the other end of the continuum, sharing information can be essential to put in place effective child protection services. Serious Case Reviews (SCRs) have shown how poor information - sharing has contributed to the deaths or serious injuries of children.

Fears about sharing information cannot be allowed to stand in the way of the need to promote the welfare and protect the safety of children.” (Working Together 2015)

This definition is inclusive of internal trafficking or trafficking of children within borders.

Care of Unaccompanied and Trafficked Children: Statutory Guidance for Local Authorities on the Care of Unaccompanied Asylum Seeking and Trafficked Children (2014) provides that where the age of a person is uncertain and there are reasons to believe that they are a child, they are presumed to be a child in order to receive immediate access to assistance, support and protection in accordance with Article 10(3) of the European Convention on action Against Trafficking in Human Beings. Age assessments should only be carried out where there is significant reason to doubt that the claimant is a child. Age assessments should not be a routine part of a local authority’s assessment of unaccompanied or trafficked children. Where age assessments are conducted, they must be Merton Compliant.

The organised crime of child trafficking into the UK has become an issue of considerable concern to all professionals with responsibility for the care and protection of children. Any form of trafficking children is an abuse. Children are coerced, deceived or forced into the control of others who seek to profit from their exploitation and suffering. Some cases involve UK-born children being trafficked within the UK.
